Judge Kevin Patrick Yeary

Texas Court of Criminal Appeals 


A Constitution(s) Primer for Texans


Texas Court of Criminal Appeals Judge Kevin Patrick Yeary will educate us on the role of the Federal and State constitutions within our government.  The US Constitution is the supreme law of the land but the States are still sovereign so their constitutions matter a great deal.  Judge Yeary will share the important distinctions between the US and Texas constitutions and how those differences shape the unique place that is the great State of Texas.  

 

Judge Yeary has served as a Judge on the Texas Court of Criminal Appeals for more than 11 years having first been elected to the Court in 2014. He was re-elected in 2020 and will stand for re-election again this year.  Judge Yeary is the only judge currently serving on the Court who previously worked for the Court as an attorney.

 

During the Court’s 1991-1992 term, Judge Yeary served as Briefing Attorney to the late Honorable Judge Bill M. White. After his clerkship year, he worked as a defense attorney in private practice and later served approximately twenty years as an Assistant District Attorney in the appellate divisions of Dallas, Harris, and Bexar Counties (serving in the offices in that order).

 

Judge Yeary has prepared and filed appellate briefs in and argued cases before both the Texas Court of Criminal Appeals and the Texas Supreme Court. He has also filed briefs in cases before the United States Supreme Court.  Judge Yeary regularly lectures and teaches on matters related to criminal law and appellate practice. He currently serves as the Court of Criminal Appeals’ liaison to the State Bar of Texas Criminal Pattern Jury Charge Committee. In addition, he serves on the board of the Texas State Law Library.  Judge Yeary is a graduate of the St. Mary's University School of Law.
